El Senado de la República aprobó en primera lectura el proyecto de ley que pretende regular, sustituir el contenido y la forma de difusión de las “Gacetas oficiales”, de los poderes Ejecutivo y Legislativo.
Este proyecto establece que solo se publicarán en la “Gaceta Oficial” las leyes, las resoluciones de la Asamblea Nacional y las bicamerales, así como decretos y reglamentos correspondientes a los poderes Ejecutivo y Legislativo.
El artículo 5 de la pieza legislativa establece que la identidad del “Proponente”, deberá ser revelada en la ley y además se tendrá que colocar el nombre de la institución de donde procede el proyecto de ley.
De igual forma, la propuesta legislativa estable que “en el caso de que el Poder Ejecutivo no haya promulgado la ley y se venza el plazo constitucional, el presidente de la cámara que remitió la pieza deberá de requerir una respuesta sobre esta constancia para la pronta publicación de la ley”.
Mientras que si la pieza es devuelta por el Poder Ejecutivo a la cámara remitente, esta deberá conocer las observaciones en un plazo de dos legislaturas y si no lo hiciese entonces el presidente de la República tendrá la potestad de promulgar la ley con las observaciones realizadas de manera automática.
Este proyecto es una propuesta del senador por la provincia San Juan de la Maguana, Félix Bautista Rosario.
Fue planteado debido a que en las actuales Gacetas Oficiales no se incluye el nombre de quien o quienes impulsan las leyes propuestas.
La Constitución de la República, en su artículo 96, establece que solo tienen derecho a presentar una iniciativa para la formación de leyes los senadores, los diputados, el presidente de la República, la Suprema Corte de Justicia (en temas judiciales) y la Junta Central Electoral (en temas electorales y de registro civil).
